Statute and Code of Ethics
What every BRACCA member commits to. The registered Statute is a separate document.
Draft pending review. This text was prepared by BRACCA's technical team so that the platform stops asking people to accept a document that does not exist. It has not been reviewed by a lawyer and has not been approved by the Board. Items in [square brackets] still need BRACCA's information.
About this document
BRACCA's Statute is the association's corporate charter — governance bodies, elections, quorum, amendment rules. It is a legal instrument that only the association and its lawyers can draft, and it is not reproduced here. What follows is the Code of Ethics, drawn from the principles of BRACCA's Membership Framework. [The Board should link or attach the registered Statute alongside this text.]
Code of Ethics
Every BRACCA member commits to the following, and membership is conditional on it.
1. The student comes first
Members act in the best interest of the student, above any commercial relationship. Where an interest of the member and an interest of the student conflict, the student's prevails.
2. No commissions for placement
Members do not accept commissions, bonuses or any per-student payment from institutions in exchange for directing students to them.
3. Full disclosure
Members disclose to students and families any relationship with an institution, agency or provider that could reasonably influence the advice given, before that advice is acted on.
4. Honest representation
Members represent admission chances, costs, deadlines and requirements accurately. They do not guarantee admission, and do not present an estimate as a certainty.
5. The student's own work
Members support students in presenting themselves. They do not write essays or application materials on a student's behalf, and do not submit anything as if it were the student's work.
6. Confidentiality
Information about a student and their family is confidential and is shared only with the student's consent or where required by law.
7. Respect between members
Members do not disparage colleagues or other institutions to gain an advantage, and do not use BRACCA's directory or channels for unsolicited commercial approaches.
8. Standing behind the association's name
Members may state that they are members of BRACCA. They do not present membership as an endorsement of their services by the association, nor use BRACCA's name or marks to suggest results the association has not promised.
Breaches
Suspected breaches are reviewed by [the Ethics Committee / the Board], which may hear the parties and decide on guidance, warning, suspension or termination. [The Board should define the procedure and the right of appeal.]
